51010 – EEO • • Overall Updates to the language Removal of “availability data” references New tone of self-assessment and self-accountability Lengthens the term from 1 to 2 years for an interim administrative position • Interims positions must be filled through regular or in-house searches that include EEO responsibilities • Provides more suggestions on how to demonstrate efforts on hiring and retaining a diverse workforce

53412 – MQs for Noncredit Faculty • Noncredit Committee currently generating issues to be considered in migrating noncredit MQs from title 5 to the Disciplines List • Does title 5 afford more protection? • Given the low representation for noncredit among delegates, how to make sure the noncredit perspective is heard

55003 – Prerequisites • Removes requirement for data analysis for English or mathematics prerequisites on courses outside these disciplines. • Content review is the only requirement for validation; statistical validation is optional. • Prerequisites continue to need review every 6 years, or 2 years if vocational courses/programs • See the latest paper in session materials • Still unknown what the accountability will be – reports, plans, tracking, etc.

55035 – Remedial Coursework • 30 unit limit for basic skills instruction • ESL is exempt from the 30 unit limit • Is this a good time to update? • Need to update because: ▫ The current regulations are confusing ▫ Some basic skills pathways now require more coursework, hence potentially more units

55040 – Repetition and Withdrawal • Added to title 5 ways that students could legitimately repeat a course (lapse of time, substandard grade, wildfires, etc. ) • Limited withdrawals to 4 • Combined repeats and withdrawals raised concerns about limiting access for other students • Current regulations allow for 2 repeats and 4 withdrawals; guidelines soon • Now back to the drawing board

55051 -2 – AP and IB • Reviewing the regulations to see if a generic version of title 5 will suffice rather than make it specific to commercial tests • Is it better to allow students to meet some college requirements by taking standardized tests (including CLEP), and adapt the regulations to be inclusive without being explicit?

55150 -5 – Noncredit • Clarity and less redundancy • Removal of 288 -hour language for short-term vocational programs • Emphasis that noncredit certificates need to undergo review by local curriculum committee • Noncredit certificates cannot be transcripted

57030 -57037 – Lab Space Allocation • All sections are repealed • Reference to California Community Colleges Policy on Utilization and Space Standards • This document replaces all old requirements; more easily updated and reflects current practices • Check with your local facilities manager to see how it will help your college/district

58170 – Referral to Supervised Tutoring • Under discussion at SACC • Proposal from Association of Colleges for Tutoring and Learning Assistance (ACTLA) to modify certain aspects of tutoring experiences (i. e. how tutors are trained and apportionment collection restrictions for categorical funds)

59204 – Implementation of 50% Law • In response to reduced funds for categorical programs • Defines “serious hardship” • Regulation lasts until 2013 • Districts may apply

What needs to change? • Language that actually moves the System forward in increasing the percentage of courses taught by full time faculty • Legislation that removes the Department of Finance’s ability to determine what is an “unfunded mandate” in Title 5 or not • Reduction in regulations overall
