The highest bodies of state power • The parliament of the Republic of Kazakhstan is the supreme representative body of the Republic which is carrying out legislative functions. It carries out the powers on the basis of the Constitution and the Constitutional law «About Parliament of the Republic of Kazakhstan and the status of its deputies» from October 16, 1995 with changes and additions. • The parliament consists of two chambers: The senate and the Mazhilis operating on a constant basis. The senate is formed by the deputies elected by two persons from each region, the city of republican value and the capital of the Republic of Kazakhstan at joint meeting of deputies of all representative bodies, accordingly from region, , the cities of republican value and the Republic capital.
The highest bodies of state power • Fifteen deputies of the Senate are appointed by the President of the Republic taking into account need of providing representation in Senate national - cultural and other significant interests of society. The Mazhilis consists of hundred and seven deputies. Election of ninety eight deputies of Mazhilis is carried out on the basis of general, equal and a direct suffrage at secret ballot. • Nine deputies of Mazhilis are elected by Assembly of the people of Kazakhstan. The next elections of deputies of Mazhilis are carried out not later than two months before the termination of a term of office of operating Parliament. The deputy of Parliament can't be the member of both chambers at the same time. A term of office of deputies of the Senate is six years, a term of office of deputies of Mazhilis is five years.
The highest bodies of state power • Election of deputies of the Senate is carried out on the basis of an indirect electoral right at secret ballot. The person who has citizenship of the Republic of Kazakhstan and constantly living on its territory last ten years can be the deputy of Parliament. • The person who is thirty years old, having a higher education and length of service not less than five years, constantly living on the territory of the corresponding area, the city of republican value or the Republic capital not less than three years can be the deputy of the Senate. The person who is twenty five years old can be the deputy of Mazhilis. The deputy of Parliament takes the oath to the people of Kazakhstan.
2. Constitutional bases of judicial authority. • Justice in the Republic of Kazakhstan is carried out only by court. Judicial authority is carried out by means of civil, criminal and other forms of legal proceedings established by the law. In the cases foreseen by the law, criminal legal proceedings are carried out with participation of jurors. Courts of the Republic are the Supreme court of the Republic and the local courts of the Republic established by the law. Establishment of special and extreme courts under any name isn't allowed.
Constitutional bases of judicial authority. • The judicial system of the Republic is established by the Constitution of the Republic and the Constitutional law of the Republic of Kazakhstan «About judicial system and the status of judges of the Republic of Kazakhstan» from December 25 of 2000 with changes and amendments. • Judicial authority is carried out on behalf of the Republic of Kazakhstan and has an aim to protect rights, freedoms and legal interests of citizens and the organizations, ensuring performance of the Constitution, laws, other legal acts, international treaties of the Republic. Judicial authority extends on all affairs and the disputes based on the Constitution, laws, other legal acts, international treaties of the Republic. Decisions, sentences and other resolutions of courts have an obligatory fulfillment on all territory of the Republic.
3. Constitutional Council • The constitutional council of the Republic of Kazakhstan consists of seven members whose liabilities last six years. Life members of the Constitutional council are ex-presidents of the Republic. The establishment and activity of the Constitutional council are regulated by the Constitutional law «About the Constitutional Council of the Republic of Kazakhstan» from December 29, 1995 with changes and amendments.
Constitutional Council • 1) solves in case of dispute a question of correctness of elections of the President of the Republic, deputies of Parliament and carrying out a republican referendum; • 2) considers before signing by the President the laws adopted by Parliament on their compliance to the Constitution of the Republic, considers to compliance of the Constitution of the Republic accepted by Parliament and its Chambers of the resolution; • 3) considers before ratification the international contracts of the Republic to compliance of their Constitution; • 4) gives official interpretation of standards of the Constitution; • 5) draws the conclusions in the cases provided by the Constitution. • 6) considers appeals of courts in the cases defined by the Constitution.
