How Press Freedom is protected? • Hong Kong Basic Law Article 27: Hong Kong residents shall have freedom of speech, of the press and of publication; freedom of association, of assembly, of procession and of demonstration; and the right and freedom to form and join trade unions, and to strike. • Over 200 international treaties such as International Covenant on Civil and Political Rights (ICCPR) etc. are applicable in HK • The Bill of Rights Ordinance (Cap 383), enacted in 1991

Media Policy: Print • No press law or media law; self-regulatory • Registration of newspapers: very easy • The Hong Kong Press Council is not effective • Subject to ordinances regarding obscenity and indecency, defamation, privacy, copyright etc.
Media Policy: Print • 3 classes for articles regarding obscenity and indecency: suitable for every one; not suitable for people under 18; and not suitable for any one • Articles can be submitted to a Tribunal to classify • The Hong Kong media seldom submit their publication for classification before publication because of press freedom and time constraints. • After publication, the media may be fined or prosecuted
