Directive 2004/49/EC The Railway Safety Directive complements market opening and technical legislation It deals with the existing railway system: • harmonising the regulatory structure in member states • defining responsibilities between actors • setting a framework for developing common safety targets and common safety methods • requiring the establishment of a safety authority and an investigation body in each member state • defining principles for management, regulation and supervision of safety 25/05/2009 Visit BG NSA – Safety Unit Presentation 2
Framework for further development Some of the provisions of the directive are to be developed in detailed decisions: • Common safety targets and methods • Assessment of safety management systems • Safety certification provisions Annexes of the directive have to be updated following technical progress • In particular common safety indicators (Annex I) The European Railway Agency has been mandated to carry out the technical work 25/05/2009 Visit BG NSA – Safety Unit Presentation 3

Achievement in regulatory fields (I) Common format for safety certificates and application documents (January 2006) Confirmed by Commission Regulation (EC) N° 653/2007 Recommendation to the Commission on the notification of national safety rules The Commission asked thereafter 7 Member States to clarify their notifications and 17 to renew notifications Common Safety Method on risk evaluation and assessment (1 st set of CSM, December 2007) Draft Commission Regulation to be adopted in summer 2009 25/05/2009 Visit BG NSA – Safety Unit Presentation 5
Achievement in regulatory fields (II) Common Safety Methods for calculation, assessment and enforcement, to be used in the framework of the 1 st set of Common Safety Targets (April 2008) Commission Decision expected in 2009 Recommendation to adapt Annex I of Directive 2004/49 with common definitions and common methods to calculate accident costs (September 2008) Under discussion with Member States in the Railway Interoperability and Safety Committee (RISC) 25/05/2009 Visit BG NSA – Safety Unit Presentation 6

Achievements in other fields Networks of safety authorities and investigation bodies have been convened since 2005 and made progress in working together The safety authorities have agreed to carry out peer reviews among them with Agency support Five working groups with subgroups involving more than 120 experts are active from 2005 on Database of safety documents is available to the public since May 2007 First report on the development of railway safety was published in autumn 2008 25/05/2009 Visit BG NSA – Safety Unit Presentation 8
