BACKGROUND The objects of the National House of Traditional Leaders Act, 2009, are – to provide for the establishment of the National House of Traditional Leaders; to determine the powers, duties and responsibilities of the House; to provide for support to the House by government; to provide for the relationship between the House and the provincial houses; and to provide for the accountability of the House. 33
DISCUSSION During a recent meeting between the Minister and the National House of Traditional Leaders, the Minister outlined his vision for the National House and the institution of traditional leadership which included the alignment of the work of the COGTA Portfolio, the National House, and the enhancement of the integrity and dignity of the National House and the institution of traditional leadership. 44
ISSUES IDENTIFIED FOR ENGAGEMENT WITH THE MINISTER Formal interaction between the Minister and the National House. To establish formal interaction between the Minister and the National House with the inclusion of MECs when necessary. To discuss the expectations of members of the National House in respect of the support from the Co. GTA Portfolio. To clarify and enhance the relationship between the National House and the Co. GTA portfolio on the one hand provincial houses, local houses, traditional councils and provincial departments responsible for traditional leadership matters on the other hand. The Minister and the National House intend to pay courtesy visits to provinces to interact with Kings, provincial houses and other stakeholders to promote collaboration and effective intergovernmental relations. 55
ISSUES IDENTIFIED FOR ENGAGEMENT WITH THE MINISTER (Continued) Co-ordination and development of a calendar of annual events by the National House to ensure an integrated approach and enhancement of cultural and traditional activities. Discussion on the state of the Co. GTA Portfolio and to examine how the National House members perceive the alignment between traditional leadership and local government. 66
SUCCESSES OF THE NATIONAL HOUSE OF TRADITIONAL LEADERS (NHTL) Properly constituted and functional House of traditional leadership, with seven (7) functional committees The House has adopted a strategic and annual performance plan and reports progress quarterly and annually on its plans. The House engaged with partners and key stakeholders (DRDLR, Social Development, SALGA, Do. J & CD, WCPD) dealing with programmes that have an impact on traditional communities. The House participated in cultural, traditional and customary events to promote indigenous knowledge systems and heritage The House participated and provided inputs into pieces of draft legislation and policies developed by government such as Traditional Courts Bill, National Traditional Affairs Bill, Spatial Planning and Land use management process, etc. In order to promote cooperative governance, the House interacts with provincial houses of traditional leadership through the Chairpersons and Secretaries Fora which meet regularly 77
Successes (cont) The following governance structures have been established to align the work of Cogta portfolio: MINNHTL : meeting between the Minister and National House of Traditional Leaders which takes place monthly MINEXCO: meeting between the Minister, the department of Traditional Affairs and Chairperson and Deputy Chair of the House including Chairpersons and Deputies of other entities. 88
Success RECONSTITUTION OF THE HOUSES Free State: provincial house reconstituted on 15 May 2012 North West: local houses to be reconstituted on 5 June and provincial house on 6 June Limpopo: local houses to be reconstituted on 23 May and provincial house on 25 May KZN: to be reconstituted by the end of July 2012 99
Success RECONSTITUTION Gauteng: should not pose any challenges as they only have two traditional councils and their senior traditional leaders will become the members of the National House 1010
Successes RECONSTITUTION Northern Cape: local houses to be reconstituted on 23 May and provincial house on 25 May Mpumalanga: members for local houses were elected, however they did not meet the one-third gender requirements; process to be redone; no new dates provided 1111

successes RECONSTITUTION Eastern Cape: reconstituted provincial house and inauguration was on 4 May 2012 National House of Traditional Leaders will be reconstituted in August 2012 after provincial reconstitution process. 1313

Conclusion The strategic leadership provided by the Executive Authority as indicated in the first strategic session with the House. There is a normal working relationship between the House and Department of Traditional Affairs (DTA) There is currently good working relationship between Cogta portfolio and the National House 1515
