MS 4 APPLICATION PROCESS Mark Fife Water Bureau Permits Section
Timeframes n n n May 22, 2008 – Watershed and Jurisdictional Permits issued. May 24, 2008 – Permits and Responsiveness Summary placed on Web site. May 28, 2008 – Application letters mailed. Applications are available on the Web site, and the application due date was established as August 1, 2008. Frequently-Asked Questions document placed on Web site. August 1, 2008 – Applications are due by this date. Applications are anticipated to be processed for reissuance from about June 1, 2008, until November 30, 2008.
Identification of Discharge Points n Any location on the MS 4 owned or operated by the permittee that discharges directly to a surface water of the state, or any location on the MS 4 owned or operated by the permittee that discharges to any other separate storm sewer system before discharging to a surface water of the state
Identification of Discharge Points con’t n n Only the discharges from discharge points identified in the application by specific location and/or category will be authorized. Two groups of discharge points for application: 1. 2. Known discharge point locations Category with estimated number of discharge points for which locations have not yet been determined
Identification of Discharge Points con’t n Known discharge points n The applicant shall identify the location(s) on its MS 4 which discharge either into an MS 4 owned or operated by another municipality or which discharge directly to a surface water of the state. This requirement may be met by submitting any of the following:
Identification of Discharge Points con’t n n A map which clearly indicates the location of each discharge point, including a unique identification code or number for each discharge point and the receiving surface water. Using Table 1 or a separate spreadsheet, a list of all the discharge point locations may be given by any of the following: street address; ¼, ¼, section, town, range; or latitude and longitude. The list shall include a unique identification code or number and the receiving water for each discharge point. n n May be submitted electronically - Excel A complete map of the applicant’s MS 4.
Identification of Discharge Points con’t n Category with estimated number of discharge points con’t n n The applicant may include a request for authorization for undetermined discharge points by category. The applicant shall include a description of any category, along with the estimated number of discharge points in the category for which discharge authorization is requested under this permit.
Identification of Discharge Points con’t n Category with estimated number of discharge points con’t The description shall contain sufficient detail for the Department of Environmental Quality to determine the specific areas being authorized. n Categories are expected to include, but may not be limited to: paved and unpaved roads with curb and gutter or roadside ditches; open or enclosed ditches, conduits, man-made channels; and/or municipally owned parking lots or property. n
Identification of Discharge Points con’t n When issued, the Certificate of Coverage (COC) will include a schedule for the applicant to provide specific discharge locations, a unique identification code or number, and the receiving surface water for each undetermined discharge points.
Post-Construction Controls 1. The applicant will implement the minimum treatment volume standard and channel protection criteria of the permit. n Submit with application: n a fixed date schedule to develop and place in effect the locally enforceable regulatory mechanism.
Post-Construction Controls con’t n This approach could be utilized when the applicant does not have procedures or an ordinance to regulate channel protection or water quality control on sites of new development or redevelopment.
Post-Construction Controls con’t 2. The applicant has an ordinance or a locally enforceable regulatory mechanism in effect at the time of application under which the authority exists to regulate treatment for water quality and criteria for channel protection. 3. Submit with application: n n The document shall be attached to the application or the application will be considered incomplete. Applicant shall identify the location of the regulatory controls in the document.
Post-Construction Controls con’t 3. The applicant has a procedure in place to regulate treatment for water quality and criteria for channel protection which has not been established as a locally enforceable regulatory mechanism. n Submit with application: n A copy of the procedure and a fixed date schedule for finalizing a locally enforceable ordinance or regulatory mechanism.
Post-Construction Controls con’t 4. The applicant intends to request approval of an alternate approach for the post-construction control requirements in the permit. n Submit with application: n The proposal for the alternate approach.
Post-Construction Controls con’t n A permittee authorizes all site plans that provide bioretention or other low-impact development based infiltration for the 2 -year, 24 -hour rain event.
Post-Construction Controls con’t 5. Elective Option (Watershed Permit only) n The applicant will develop an ordinance or other regulatory mechanism based on: • • • n Water quality priorities identified in the Water Management Plan Scientifically-accepted channel protection criteria Long-term Operations and Maintenance plan Submit with the application: n A fixed date schedule for developing and finalizing the regulatory mechanism
Post-Construction Controls con’t n Elective Option (Watershed Permit only) con’t n Submit standards and criteria by date specified in the COC as a COC modification request
Post-Construction con’t n Applicants may use more than one of these options to satisfy these requirements.
