Montenegro Negotiating Team for the Accession of Montenegro to the European Union Working Group for Chapter 14 - Transport policy CURRENT AND UPCOMING ACTIVITIES q The new Law on the Transport of Dangerous Goods, which is currently in the legislative procedure which law making and adoption represents a further harmonization of legislation of Montenegro with European Union in the area of transport of dangerous goods, and are consistent with the following directives: § Directive 95/50/EC of 6 October 1995 on uniform procedures for checks on the transport of dangerous goods by road § Directive 2008/68/EC of 24 September 2008 on the inland transport of dangerous goods q Transposition into national law and implementation: § Directive 2010/35/EU of the European Parliament and of the Council of 16 June 2010 on transportable pressure equipment and repealing Council Directives 76/767/EEC, 84/525/EEC, 84/526/EEC, 84/527/EEC and 1999/36/EC MONTENEGRO Chapter 14: TRANSPORT Negotiating Team for the Accession of Montenegro to the European Union § Commission Directive 2002/50/EC of 6 June 2002
Montenegro Negotiating Team for the Accession of Montenegro to the European Union Working Group for Chapter 14 - Transport policy CURRENT AND UPCOMING ACTIVITIES Specific objectives in the work program of the Department of Preventive and inspection control, which is part of Department for emergency situations and civil security are overseeing the following areas: § production, circulation and transportation of dangerous goods, § transportation and transit of arms, military equipment and dual-use goods § monitoring the implementation of laws regulating explosives, flammable liquids and gases § control of technical documentation for the objects that define MONTENEGRO the danger zone Chapter 14: TRANSPORT Negotiating Team for the Accession of Montenegro to the European Union
Montenegro Negotiating Team for the Accession of Montenegro to the European Union Working Group for Chapter 14 - Transport policy Department of Prevention and inspection control developed methodology for issuance of approval for procurement and transportation of explosives. Regional units after receipt of the request for procurement or transportation of explosives, and performed the necessary checks are submitted on a single form, all the necessary information about the applicant with the types and quantities of explosives, place of procurement and the direction of transport. The data is immediately stored in a database, and Regional unit notifies in writing, after which the permit is issued for the purchase or transport of explosive substances. As results of this procedure are: § Traffic and transport of explosives are actively monitored on multi-levels, executive and control-supervisory § All information coming to one place, and we can always get accurate information about traffic and transport of explosives to the level of Montenegro § For the teritory of Montenegro data base is developed which consist all necessary data about traffic and transport of explosive substances. § It can not be that explosive material reaches its destination before pass off transport document MONTENEGRO Chapter 14: Negotiating Team transportation explosive substances can be immediately TRANSPORT § Traffic and for the Accession of Montenegro to the European Union reconciled

Also, the Department issue Consent for transport of toxic and radioactive substances (Class 6 and 7), after which the Ministry of Health issued the approval for transport. Montenegro Negotiating Team for the Accession of Montenegro to the European Union Working Group for Chapter 14 - Transport policy Montenegro has a total of 105 locations to which dangerous goods class-2 and 3 are transported. These sites include the o Station for petrol and LPG - 92 o Yachting services - 5 o Petroleum installations - 3 o Locations for the fuel supply of vessels from tank trucks - 3 o. Terminals for supply of air-crafts - 2 In addition to these sites, which continuously performs supply of fuel, in Montenegro there a significant number of companies and public institutions to which the transport of various energy sources is performed and so on. Energy Regulatory Agency, on the basis of the Energy Law issue licenses for the sale, supply, storage and distribution of petroleum products and gas. üIn the last 5 years Montenegro didn’t have emergency events related to the transportation of dangerous materials.
Montenegro Negotiating Team for the Accession of Montenegro to the European Union Working Group for Chapter 14 - Transport policy Ministry of Transport and Maritime Affairs, in cooperation with the Ministry of Interior on the basis of The Law on transport of dangerous goods, in July of 2012 adopted the Rulebook on determining the ways in which they can carry dangerous goods. This regulation defines the ways in which vehicle it can move transporting dangerous goods and the parking and stopping of vehicles carrying dangerous goods. Ministry of Interior of Montenegro was among the first in the immediate environment developed a new certificate for drivers who transport dangerous goods in accordance with the ADR in 2011 (section 1. 6. 1. 21 and 8. 2. 2. 8. 5) In Montenegro, there are three companies that provide professional training for drivers of motor vehicles transporting dangerous goods and other persons involved in the preparation for transport, loading, unloading and unloading of dangerous goods, as well as an institution that is authorized to control vehicles MONTENEGRO Chapter 14: TRANSPORT Negotiating Team for the Accession of Montenegro to the European Union carrying dangerous goods in accordance with ADR.

Montenegro Negotiating Team for the Accession of Montenegro to the European Union Working Group for Chapter 14 - Transport policy q In the next period, it is expected the adoption of a new Law on Transport of dangerous goods in the Parliament of Montenegro, while the amendments to the Law on explosive materials are planned for the 3 rd quarter of this year. q In the period ahead planned activities that wil be implemented in continuity are: §Inspection activities in the production and transportation of dangerous goods, transportation and transit of arms, military equipment and dual-use goods and supervision over the implementation of legislation regulating the field of explosives, flammable liquids and gases. §Issuing a certificate of passing the professional examination for persons who participate in the preparation for transport, loading, reloading and unloading of hazardous substances, §Issuing ADR certificate on professional qualifications for drivers of motor MONTENEGRO Negotiating Team for the Accession of Montenegro to the European Union vehicles which transport dangerous goods.
