GN 9 of 2017 – Consumer Protection Act Consumer Protection (Safety Requirements) Regulations 2017 o Into operation as from 1 st October 2017. o The schedule refers to 20 goods. o Will be based on the verification of Certificates of Conformity (Co. C). o Verification of Co. Cs will be done by the Mauritius Standards Bureau. o The imported goods shall be tested by the MSB if the goods are not covered by a Co. C. o Enforcement Authority: Ministry of Industry, Commerce and Consumer Protection. 3
Procedure – Safety Regulations o Importers shall submit the Co. C and other related documents to the Mauritius Standards Bureau. o Mauritius Standards Bureau A formal request form shall be available on the MSB’s Website. Importers should fill in the request form for verification of Co. C and submit to the MSB shall proceed to verification of the submitted documents and shall issue a letter of conformance/non-conformance to the importer. 4
Controlled Goods o The schedule of the regulation refers to 20 household electrical appliances and accessories. Testing – Safety requirements o In the absence of Co. C The goods controlled under this regulation shall also be subject to testing by the MSB if a Co. C is not available or if the submitted Co. C is not relevant. o Safety Standards The Safety Standards for testing cover several aspects which include Electrical, Mechanical and Fire o Tests Under the scope of this regulation, the following aspects will be considered. ü Visual Inspection which include for e. g. Marking and instructions, construction amongst others ü Power input and current consumption ü Di-electric strength test ü Leakage current test ü Earth resistance test ü Insulation Resistance test 7
Verification of Co. Cs o Documents to be submitted to MSB ü Letter of request with details of the importer ü Proforma Invoices ü Certificate of Conformity (should cover the make/model of the product being imported) o The processing time is 2 – 5 working days. o A fee of 700 MUR per certificate verified will be charged by MSB. 8
Content of Co. Cs o A valid Certificate of Conformity should contain the following information. ü Certifying Body or Testing Laboratory ü Applicant Name (if different from Factory Name) ü Factory Name ü Certificate Number ü Date of Issue ü Date of Validity (if applicable) ü Make and /or Model (s) (if applicable) ü Standard and Year published ü Technical Signatory 9
Certificate of Conformity o As per the regulations, the following shall be submitted by the importer. ü an original or certified copy of the Co. C o Only Co. Cs issued by an independent (Third Party) conformity assessment body shall be accepted. o The Co. C shall have a validity date. 10
