Legal Requirements - 4 w Custom clearance in port of entry n n RPC Scheme: Certified products can pass through custom directly without any further inspection. TABI Scheme: Importers are required to file an application for inspection with the BSMI each time before these products arrive the port of entry. 6

Conformity Assessment Procedures -2 w RPC Scheme n Module II + IV, V or VII l Module II-Type Test Module w The applicant must have their products type- tested by the BSMI or designated testing laboratories recognized by the BSMI. 12

Conformity Assessment Procedures -3 w RPC Scheme n Module II + IV, V or VII l Module IV, V-Full Quality Management System Module, Production Quality Management Module w The production premise is required to establish a quality management system, and to obtain a registration certificate from the BSMI or certification bodies recognized by the BSMI, in accordance with the CNS 12680 (ISO 9000) series of standards. 13

Conformity Assessment Procedures - 4 w RPC Scheme n Module II + IV, V or VII l Module VII-Factory Inspection Module w The production premise is required to establish a quality management system that complies with the requirements stipulated by the BSMI, and to obtain a factory inspection report issued by the BSMI, or organizations recognized by the BSMI. 14

Conformity Assessment Procedures - 14 n TABI Scheme Issued Certificate: Type Approval Certificate l Custom clearance: l w Importers are required to file an application for inspection with the BSMI each time before these products arrive the port of entry. w First application for importer must take sample for testing w A random-sampling batch inspection with 5 % probability (not sampled for document review only) 25

Conformity Assessment Procedures - 16 w TABI Scheme n Relevant fees l Type l test fee (the same as RPC Scheme) Governing Fees for TABI w Examination for Application fee: NT$ 3, 500 for each main type and NT$ 2, 000 for each type in a series; w Certificate fee: NT$ 500 for each certificate l The fees for application of TABI inspection as entry in the port will be collected with rate of 0. 25% based on the CIF prices. 27

Market Surveillance w BSMI will setup annual market surveillance plan for plywood. The plywood samples will be taken from market for testing. w The test results fail to meet the requirements the certificates shall be abolished. 28

Penal Provision w violated the Article 59 of the Act for labeling requirements: fine not less NTD 100, 000, but not more than NTD 1, 000 w violated the Article 60 of the Act for importing commodity that not conform to the legal requirements: fine not less NTD 250, 000, but not more than NTD 2, 500, 000 29
