Internal Review of Licence Fees · Industry Canada sets fees to be reflective of market value, in order to encourage efficient use of spectrum and provide a fair return to all Canadians • Industry Canada is undertaking an internal review of all fees Upon completion of a review, Industry Canada will publish its findings and may recommend changes – Stakeholder comments would be sought on any potential changes 1
Upcoming Renewal Processes for Spectrum Licences 2300 MHz and 3500 MHz licences – Begin expiring in 2014 – Consultation on Renewal Process anticipated in October 24 GHz and 38 GHz licences – Begin expiring in 2015 – Consultation on Renewal Process anticipated in 2013 2
Ownership and Control Reviews On June 29, 2012 Bill C-38 received Royal Assent Amendments made to Telecommunications Act relating to eligibility New Exemption from Review: – If applicant’s/licensee’s annual revenues (including the revenues of all of its affiliates) from the provision of telecommunications services in Canada represent less than 10% of the total annual revenues nationally (current 10% threshold is $4. 27 billion in annual revenues as determined by CRTC on annual basis) Minister must come to his own determination with respect to meeting the eligibility requirement Upon request, applicants / existing licensees to provide IC with: – corporate documents to demonstrate eligible to hold a licence as a carrier under section 10. 2. e. g. certificate of incorporation in Canada; – brief written description of their annual revenues from the provision of telecommunications services in Canada; and – corporate documents upon which they made this assessment, e. g. financial statement If not exempt, then: – licensee must demonstrate that it is eligible to hold a licence as a carrier (full Canadian ownership and control requirements) under section 10 of the Radiocommunications Regulations, and provide supporting documentation for our review 3

CEAA Review Canadian Environmental Assessment Act 2012 Former CEAA captured many small projects that had low risk of environmental impact CEAA 2012 focuses on major projects with high risk – Set out in Regulations Designating Physical Activities (similar to former Inclusion List Regulations) CEAA 2012 covers projects on federal lands, or are financially supported federally if located outside Canada Annual reports are to be provided to Parliament Industry Canada still in early stages of understanding operational implications 8
