One of the tasks of the Customs authorities is to investigate and to establish any breach or attempted breach of the current customs regulations.
In some countries customs offences may be dealt with by the Customs authorities in accordance with procedures which are laid down in national legislation.
National legislation confers upon the Customs authorities a wide range of investigatory powers in connection with customs offences. For example, they can examine the production of documents and search persons and premises.
In case a customs offence is serious it is brought before the administrative tribunals or courts of law.
When a customs offence has been established, the Customs authorities have the right to take the necessary precautionary measures and to seize or detain the goods and means of transport.
The penalties for customs offences vary according to the seriousness or the importance of the offences. Some customs offences are serious and they may have severe consequences, and in case they are of minor importance only a small fine is generally imposed.
If certain conditions are fulfilled in particular if no fraudulent intent is involved there is normally no penalty.
Depending on seriousness of the customs offence, the Customs authorities may be empowered to require security, to seize or detain the goods and means of transport, or detain the persons concerned and hand them over to the other competent authorities.
After discovering a customs offence the Customs authorities inform the person concerned as soon aspossible of the nature of the offence, the legal provisions that have been contravened and the possible penalties.
Goods are not to be seized or detained in case they are not liable to confiscation.
The penalties commonly applicable are fines, seizure of the goods and confiscation of the means of transport.
The fines are usually based on the amount of the duties and taxes and not on the value of the goods.
