Demonstration Project n n September 6, 2007 – FMCSA began demonstration project 28 Mexican carriers and 10 US carriers participated in the project
Demonstration Project n The project was conducted under a very controlled environment that included : Ø Ø Initial screening of carriers and drivers based on previous safety performance A pre-authority Safety Audit Followed by a more comprehensive compliance review And installation of GPS unites to monitor the carrier’s operations n 20, 374 – Number of Mexican carrier Crossings into the U. S. n 4, 035 trips by US carriers into Mexico
Demonstration Project n Mexico-domiciled demonstration project carrier OOS rates from September 7, 2007 to September 6, 2008 Ø Driver = 0. 5% Ø Vehicle = 8. 7% n All US motor carrier OOS rates from September 7, 2007 to September 6, 2008 Ø Ø Driver = 7. 2% Vehicle = 22. 6%
Demonstration Project n n n August 4, 2008 – FMCSA announced 2 -year extension March 11, 2009 - Demonstration Project was terminated The Fiscal Year 2009 Omnibus Appropriations Act prohibits any funds being used directly or indirectly to “establish, implement, continue, promote, or in any way permit” a crossborder trucking program with Mexico
New Trucking Program n n President asked USDOT Secretary to work with interested groups to propose legislation creating a new Program Satisfy the concerns of Congress and meet our NAFTA commitments
U. S. – Canada Initiatives (Safety Rating Reciprocity) n n n April 29, 1994 – U. S. and Canada signed memorandum of understanding relating to the reciprocal recognition of motor carrier safety ratings September 2008 – Achieved reciprocal recognition through exchange of letters Both countries are working towards full exchange of crash and inspection data
U. S. – Canada Initiatives (Automated Commercial Environment/ International Trade Data System (ACE/ITDS) n ACE/ITDS is a Customs and Border Protection information system Ø Ø n It purpose is to facilitate legitimate trade and strengthen border security. Motor carriers are required to file e-manifest at least 1 hour prior to US entry Issues verified by FMCSA for ACE/ITDS include Ø Ø Ø Validity of drivers license, Status of USDOT Number and Operating Authority, and Outstanding penalties
U. S. – Canada Initiatives (Automated Commercial Environment/ International Trade Data System (ACE/ITDS) n n n If an issue is detected, the e-Manifest filer is notified via ACE FMCSA will conduct inspection of carriers with issues, if warranted Anticipated to “go live” in the Fall of 2009
Joint Cross-Border Issues n n FMCSA needs space at ports of entry to carry out its safety responsibilities Establish a closer working relationship with CBP and GSA Need advance notice of facility and operational changes Modification of existing facilities and construction of new ports of entry Ø Ø Ø Hours of operations Type of crossings Lane changes
