Creation of constitution First Constitution of the Republic of Kazakhstan was written in 1993 year The new Constitution of the RK was proposed on August 30, 1995 was adopted and came into force on September 5, 1995.

Constitution of the RK consists of 9 sections and 98 articles: • Section 1 – General Provisions; • Section 2 – The individual and Citizen; • Section 3 – President; • Section 4 – Parliament; • Section 5 – Government; • Section 6 – Constitutional Council; • Section 7 – Court and Justice; • Section 8 – Local Public Administration and self-Administration; • Section 9 – Concluding and Transitional Provisions.
Constitution is the main source of laws • Constitution is the main source of laws and other normative acts established by state bodies. Every law, President’s orders, regulative acts of government, resolutions of different ministers, decisions of local state bodies must be adopted on the base and in accordance with the norms, ideas, principles of Constitution and do not contradict them. In the case of contradiction they are called unconstitutional and must be abolished.
Constitutional Council • Constitutional Council consists of 7 members with term sitting of 6 years with the immunity power. Life long members of the Council are former presidents.

• Constitutional Council decides disputable questions concerning: • Elections of the President; • Elections of the Parliament deputies; • Republican referendum.
Laws of the RK define special relationships with the CIS countries on the questions of citizenship. There is special simple order of citizenship adoption between CIS countries. A man and a citizen have all rights to get education, health, occupation, dignity and a like.
All these rights and freedoms are in many laws which provide their guarantees : • Private rights and freedoms – health dignity, honor, and life • Economic and social rights and freedoms – economic and freedom rights for man’s realization of his/her material production possibilities • Political rights and freedoms – political connection between a state and its citizens
Main provisions of political rights and freedoms are written in the Constitution of the RK • Political party is voluntary unity of people of the certain country, with their political will and participation in state governing through their representatives. State provides their rights and legal interests.
