Buy America Requirement The Buy America Act, 23 U. S. C. § 313, prohibits Buy America Requirement The Buy America Act, 23 U. S. C. § 313, prohibits States from using highway safety grant funds under 23 U. S. C. Chapter 4 to purchase products, unless they are produced in the United States. This prohibition applies to steel, iron, and all manufactured products, unless the Secretary of Transportation has determined that it is appropriate to waive the Buy America Act requirement. There is no minimum purchase threshold that exempts the need for a waiver. 31
